Terms And Conditions

DEFINITIONS: Cocoda Arts, Photographer, Videographer and We mean Photographer(s) and/or Videographer(s) and owner of Cocoda Arts or photographer(s) and video crew(s) hired by Cocoda Arts. Client(s) means any person, body of persons, firm or company with whom our Photographer and/or Videographer enters into a contract for the sale of goods or provision of services by Cocoda Arts. Photographs, Images, Videos, Products, Final Products, End Products and Works means all photographic and/or video material furnished by the Photographer and Videographer, whether transparencies, negatives, prints, digital files or any other type of physical or electronic material in existence now or yet to be developed. Event(s) refers to any planned private, public or social occasions related to Cocoda arts service(s) and special event refers to wedding and engagement.

 

COPYRIGHT: Full payment for services rendered determines the release of the End Product(s) to the client. Upon full payment, the End Product(s) become the property of the client for their personal use and for the purpose of reproduction of photos or video for distribution to relatives and friends. Images and videos may be used on personal websites. An acknowledgement to Cocoda Arts is requested and appreciated. We retain the right to use any Images and videos of clients for profit and self-promotion.

 

The client must obtain written permission from, and compensate, Cocoda Arts prior to an event where the client, the client’s friends of relatives publish or sell the photographs and/or videos for profit.

 

PAPARAZZI AND SPECIAL EVENT GUESTS: All your guests will have digital cameras and all your guests will want to photograph Key moments of the Clients. In the spirit of cheerful cooperation the Clients agree to give Cocoda Arts precedence over the guests in order to take the photographs and/or videos required for the event of services described above. We cannot be held liable for a lack of event photos and/or videos if guests taking their own photos of the Clients continually interrupt the Photographer’s or Videographer’s work.

 

HARASSMENT: Ensuring the appropriate behaviour of all guests and other persons at the wedding and other events covered by Cocoda Arts shall be the responsibility of Clients. In the event Cocoda Arts or their employee experiences any inappropriate, threatening, hostile or offensive behaviour from any guest or other person at the wedding or other event (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature) then the following process shall be followed: first offense: a verbal warning will be issued to a family member of the client; second offense: the offending person will be required to leave the wedding or event; third offense: Photographer and/or Videographer will end the event coverage immediately and leave, Cocoda Arts shall be entitled to retain all monies paid hereunder and client agrees to relieve and hold Cocoda Arts and their team harmless as a result of incomplete wedding or event coverage.

 

ADDITIONAL TIME: It is not uncommon for any event to go on longer than planned. We are flexible, and will allow an additional one hour for a late-running event. However, additional overtime fees are RM180/hour for the Photographer and Videographer respectively. The client is thereof notified shoots commences at the scheduled start time and ends at the agreed time. If the event goes longer and the client wishes an extension past one hour, a verbal acknowledgement is sufficient.

 

Should the event ceremony start late due to any reason whatsoever, we will not be held liable for any photographs and/or videos not taken.

 

GOOD IMAGERY: In order to ensure we get good pictures during special event, we may do several shots of the same thing using different cameras, poses and lighting. We cannot guarantee a certain number of photos; however it is expected we take between 300 and 1000 useable photos per event. We are providing a large selection of the useable photos only which will be a minimum of 300 guaranteed. Useable photos mean they are in focus, properly exposed, shadow and highlight detail are completely visible and camera flash are used believable. The rest of them are available on request at no charge.

 

The final post production and editing styles, effects, and overall look of the images and/or videos are left to the discretion of Cocoda Arts. Some images or videos will be given special care and attention for basic enhancement to suit the overall concept of the event.

 

HOUSE RULES: Cocoda Arts are limited by the guidelines of the ceremony official or the reception site management. Negotiations with the officials for moderation of guidelines are the client’s responsibility. We will offer technical recommendations only. We will do our best to accommodate any request within reasonable terms, and we will also make suggestions and provide direction if necessary.

 

COOPERATION: The Clients and Cocoda Arts consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. We recommend that the Photographer be provided with a helper (someone who knows most of the guests) who will point out key individuals to be photographed. The Photographer may also require assistance in organizing family groups. The Clients also agree to give the Photographer sufficient warning of key events to give the Photographer time to prepare e.g. cutting the cake, speeches, first dance etc. Please note that not all guests like having their photo taken. In such cases the Photographer will use his discretion but cannot be held responsible for a lack of photos of these people.

 

Since special events are very unpredictable by nature, Cocoda Arts does not guarantee any one picture and/or video of certain subjects or family members to appear. Cocoda Arts will make every effort to coordinate the special event timeline and shot lists with the Client to ensure that all parties involved in the picture taking are present when it is time. It is the Client’s responsibility (or their designated coordinator) to make sure that the important people they want to be photographed or recorded in a video camera are at the agreed location and time.

 

MEALS: The Clients agree to provide a meal(s) for Cocoda Arts and their team during the time when everyone is eating if the length of attendance exceeds five hours.

 

RETAINER: A retainer of half of the total package(s) price will secure Cocoda Arts services for the client’s specified event date.  In the event of the client’s cancellation, the retainer is non-refundable. If Cocoda Arts is cancelling the event due to unexpected critical reasons, the full amount will be refunded.

 

LIMITS OF LIABILITY: It is further understood that in the unlikely event we are injured or becomes too ill to cover the event or due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package(s).

 

WARRANTY: All clients are entitling with 7 days of warranty on items such as DVD and/or PENDRIVE for malfunction only starting from the day of receiving the end product(s). Any warranty claims of DVD and/or PENDRIVE during the warranty period the malfunction DVD and/or PENDRIVE must be returned to Cocoda Arts as it is by any means for the replacement procedure. We will not be held responsible for any damages or malfunction on the end products after handing it over to the client due to natural disaster, accident or human error handling while the warranty is taking effect.

 

DELIVERY TIME: Our standard timeline delivering the final product is between 3 weeks to 12 weeks if there aren't any emergency or other unforeseen circumstances from both parties. It also depends on jobs in hand and might be longer if a time extension is inevitable. We will inform the Client on the status of their Product(s) progress. We reserved the right to hold on to the delivery of the Product(s) in the case of the client has not settled any payment required by Cocoda Arts.

 

FEES: Full payment for the services of Cocoda Arts is due when we notified the clients that the end product is ready to be delivered and collected in Ranau. Any special shipping costs will be paid for by the client. All receipts and invoices will be sent to the client’s email account unless other agreements have been made.
